Agreement
These Terms of Service govern your access to and use of HumVision, including the gethumvision.com website, account dashboard, APIs, downloads, Supabase-backed web APIs, Team and Department workspace features, and the HumVision desktop application.
By creating an account, downloading HumVision, starting a trial, buying a plan, inviting a team member, or using the app, you agree to these Terms. If you use HumVision for an organization, agency, department, team, company, or other entity, you represent that you have authority to accept these Terms for that organization.
Accounts and eligibility
You need a HumVision account to start a trial, download authenticated releases, activate a license, manage billing, register devices, or use Team and Department collaboration. You must provide accurate account information and keep your credentials secure.
- You are responsible for activity under your account, including actions taken by invited operators and organization admins.
- You must notify us promptly if you believe your account, device, shared workspace, or credentials have been compromised.
- HumVision is intended for adult professional, organizational, research, or personal operator use. It is not intended for children under 16.
- We may refuse, suspend, or terminate access if information is inaccurate, payment fails, access is revoked, or use violates these Terms.
Plans and licenses
HumVision offers Trial, Pro, Team, and Department access. Plan names, pricing, features, limits, and availability may change prospectively, but current plan behavior is:
- Trial: a 30-day trial with no credit card required. Trial access may enter a read-only grace state after expiration and may be limited until you activate a paid plan.
- Pro: a one-time individual license for one operator on up to two registered computers. Pro is for individual use, not an organization-wide shared workspace.
- Team: an annual flat-rate organization subscription for one SAR, dive, water-rescue, survey, or similar unit, currently capped at up to 10 operators. Team includes shared recordings, shared projects, organization storage, and live contact and annotation sync.
- Department: an annual flat-rate organization subscription for larger departments or multi-operator organizations. Department includes the Team workspace plus unlimited operators and organization branding features.
A license is limited, non-exclusive, non-transferable, and revocable. You may not sell, sublicense, rent, lease, share, or transfer your account, installer, license, device registration, or organization access except through the account and seat-management flows we provide.
Offline use and device checks
HumVision is designed to keep field work moving when a laptop has no internet connection. After a successful online sign-in or license refresh, the desktop app can continue working offline for a limited period based on locally stored license state.
- The app must periodically reach HumVision and Supabase services to refresh account and license state.
- Pro licenses are device-limited. The app may register a short hashed machine ID and compare it to the machine IDs associated with your license.
- Team and Department access depends on active organization claims, seat assignment, role, and subscription status.
- If a trial, subscription, seat, organization claim, or license refresh expires or is revoked, the app may become read-only, restrict exports or annotations, or require sign-in before continued use.
Recordings and customer content
You keep ownership of your recordings, projects, notes, contacts, annotations, GPS tracks, exports, organization profile, logos, and other content you import, create, upload, or share through HumVision.
You grant HumVision the limited permission needed to operate the product, including storing account records, displaying shared workspace metadata, syncing shared contacts and annotations, processing uploaded organization logos, generating signed upload and download URLs, storing shared recording archives, providing support, enforcing access controls, and maintaining backups and logs.
- Unshared local recordings and projects remain on your device. HumVision does not receive them merely because you open or review them.
- When you share a recording, HumVision uploads a recording-folder archive and related metadata to the organization workspace so other authorized members can access it.
- When you share a project, HumVision may share project metadata and upload member recordings associated with that shared project.
- Organization admins may be able to invite, revoke, reassign, view, download, or remove shared workspace content according to plan and role controls.
Operator responsibility
HumVision helps operators review Humminbird sonar recordings, mark contacts, inspect GPS tracks, generate mosaics, and export files for handoff. You remain responsible for how the work is performed and used.
- Verify findings using appropriate field procedures, trained personnel, original source data, and independent judgment.
- Do not use HumVision as the sole basis for life-safety, navigation, search termination, legal, evidentiary, engineering, medical, or public-safety decisions.
- GPS data, basemaps, satellite imagery, depth readings, track smoothing, mosaics, and exports may be incomplete, delayed, inaccurate, or affected by source-device limitations.
- You are responsible for complying with agency policy, chain-of-custody requirements, privacy obligations, records laws, public-records laws, court orders, and operational restrictions that apply to your work.
Acceptable use
You may not use HumVision to:
- Break the law, violate another person's rights, or process content you do not have authority to use.
- Upload malware, exploit code, illegal content, or content that infringes intellectual property, privacy, publicity, confidentiality, or contractual rights.
- Attempt to bypass license limits, payment requirements, device limits, seat limits, authentication, authorization, signed URL checks, or storage path controls.
- Reverse engineer, decompile, disassemble, scrape, crawl, benchmark for publication, or extract source code except where applicable law expressly allows it despite this restriction.
- Resell, white-label, host, sublicense, or provide HumVision as a service bureau or managed service without written permission.
- Interfere with Supabase, Stripe, Cloudflare R2, GitHub, Vercel, map providers, or any other service connected to HumVision.
Billing, renewals, and refunds
Stripe processes HumVision payments. By purchasing a paid plan, you authorize Stripe and HumVision to process charges, invoices, renewals, taxes, refunds, payment failures, and related billing records for the selected plan.
- Pro is currently sold as a one-time purchase for the then-available Pro license, subject to these Terms and device limits.
- Team and Department are annual subscriptions. Unless you cancel before renewal through Stripe or a supported account flow, the subscription may renew for another term.
- Cancellations generally take effect at the end of the current billing period unless Stripe or a written agreement states otherwise.
- HumVision offers a 30-day refund window for paid tiers. Email hello@gethumvision.com within 30 days of purchase or renewal to request a refund. We may refuse refund requests involving abuse, fraud, chargeback misuse, repeated refund cycling, or use outside these Terms.
- Plan changes, upgrades, credits, nonprofit discounts, and department procurement requests may require manual support handling.
Downloads, updates, and availability
HumVision desktop releases are distributed through authenticated web downloads and GitHub Releases. Production builds may check for updates and offer or install new versions.
- We may add, change, suspend, or remove features, plans, APIs, file support, map providers, collaboration limits, storage limits, or dashboard surfaces.
- Some features may be beta, experimental, roadmap-only, or subject to additional requirements such as internet access, storage availability, map keys, supported operating systems, or active plan status.
- We do not guarantee that HumVision, hosting providers, app downloads, billing providers, cloud storage, map tiles, or third-party services will be uninterrupted or error-free.
- You are responsible for keeping exported files, source recordings, local backups, and operational records outside HumVision where required by your workflow or law.
Third-party services and names
HumVision depends on third-party services, including Supabase, Stripe, Cloudflare R2, Vercel, GitHub Releases, MapTiler, OpenStreetMap, Esri, Carto, OpenTopoMap, operating-system services, email providers, and other infrastructure providers.
Those services may have their own terms, privacy notices, acceptable-use rules, rate limits, downtime, map-data limitations, attribution requirements, and security practices. HumVision is not responsible for third-party services it does not control.
Humminbird, Google Earth, ArcGIS, Stripe, Supabase, Cloudflare, GitHub, Vercel, MapTiler, OpenStreetMap, Esri, Carto, OpenTopoMap, and other third-party names belong to their respective owners. HumVision is not affiliated with or endorsed by Humminbird unless we say so in writing.
HumVision intellectual property
HumVision, including the app, website, dashboard, code, design, workflows, branding, documentation, screenshots, product copy, icons, and related materials, is owned by HumVision or its licensors and is protected by intellectual property laws.
You may use HumVision only as allowed by these Terms. Feedback, suggestions, feature ideas, bug reports, and other input you send may be used by HumVision without restriction or compensation, but you keep ownership of your underlying customer content.
Privacy
The HumVision Privacy Policy explains how we handle personal information, shared workspace data, license state, billing records, and optional shared recording archives. The Privacy Policy is part of these Terms.
Suspension and termination
You may stop using HumVision at any time. You may cancel subscriptions through Stripe or supported billing flows. You may request account deletion by contacting support or using available account controls.
We may suspend or terminate access, revoke entitlements, remove content, disable shared workspaces, or refuse future service if we reasonably believe there is a violation of these Terms, payment failure, fraud, security risk, legal risk, abuse, or harm to HumVision, users, providers, or third parties.
After termination, provisions that by their nature should survive will survive, including ownership, payment obligations, warranty disclaimers, liability limits, indemnity, dispute terms, and restrictions on misuse.
Disclaimers
To the maximum extent allowed by law, HumVision is provided "as is" and "as available." We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted operation.
We do not warrant that HumVision will identify every contact, preserve every record, meet every agency requirement, satisfy evidentiary standards, render every recording correctly, support every Humminbird firmware variant, maintain every map provider, or produce exports accepted by every downstream system.
Limitation of liability
To the maximum extent allowed by law, HumVision and its owners, employees, contractors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost data, lost recordings, lost exports, business interruption, operational delay, failed search outcomes, procurement delay, or third-party service failure.
To the maximum extent allowed by law, HumVision's total liability for all claims relating to the product or these Terms is limited to the amount you paid to HumVision for the plan giving rise to the claim during the 12 months before the event giving rise to liability, or USD $100 if you did not pay HumVision during that period.
Indemnity
To the extent allowed by law, you will defend, indemnify, and hold harmless HumVision and its owners, employees, contractors, vendors, and service providers from claims, damages, liabilities, losses, and expenses arising from your content, your organization workspace, your use of HumVision, your violation of these Terms, your violation of law, or your violation of another person's rights.
Disputes and notices
Before filing a legal claim, contact us at hello@gethumvision.com so we can try to resolve the issue informally. Legal notices to HumVision should be sent to that email address unless a written agreement provides another notice method.
Unless a required law gives you another forum or governing law, disputes will be handled individually in courts that have jurisdiction over HumVision and the dispute, and these Terms will be interpreted under the laws applicable to HumVision without regard to conflict-of-law rules.
Changes to these Terms
We may update these Terms as HumVision changes. The updated version will be posted on this page with a new last updated date. If a change is material, we will provide additional notice when required by law. Continued use after the effective date of updated Terms means you accept the updated Terms.
